Any person claiming damages from a common carrier on account of any violation of the
provisionsofchapter327Dmayeithermakecomplainttothedepartment,ormaybringaction
on the person’s behalf for the recovery of such damages; but the person shall not have the
right to pursue both of said remedies at the same time.
