1. The secretary is authorized, after public hearing following due notice, to make
appropriate rules for carrying out the provisions of this chapter, including rules providing
for the collection and chemical examination of samples of pesticides or devices.
2. a. Thesecretary, includingthesecretary’sauthorizedagents, inspectors, oremployees,
may enter into or upon any place during reasonable business hours in order to do any of the
following:
(1)Take periodic random samples for chemical examinations of pesticides and devices.
(2)Open any bundle, package or other container containing or believed to contain
a pesticide in order to determine whether the pesticide or device complies with the
requirements of this chapter.
(3)Monitor the use of or review the pesticide application.

agricultural chemists.
3. The secretary of agriculture, in cooperation with the advisory committee created
pursuant to section 206.23, shall designate areas with a history of concerns regarding nearby
pesticide applications as pesticide management areas. The secretary shall adopt rules for
designating pesticide management areas.
