§ 159.1 — Definitions

For the purposes of subtitles 1 through 3 of this title, excluding chapters 161A and 161C,
unless otherwise provided:
1. “Department” means the department of agriculture and land stewardship and if the
department is required or authorized to do an act, unless otherwise provided, the act may be
performed by an officer, regular assistant, or duly authorized agent of the department.
2. “Person” includes an individual, a corporation, company, firm, society, or association;
and the act, omission, or conduct of any officer, agent, or other person acting in a
representative capacity shall be imputed to the organization or person represented, and the

person acting in such capacity shall also be liable for violation of subtitles 1 through 3 of this
Title, excluding chapters 161A and 161C.
3. “Secretary” means the secretary of agriculture.
