The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

(1)a. “Beneficial interest” shall include any of the following: 1. The interests of a person as a beneficiary under any trust arrangement under which a trustee holds legal or record title to personal or real property; or 2. The interests of a person, under any other form of express fiduciary arrangement, pursuant to which any other person holds legal or record title to personal or real property for the benefit of such person. b.
