§ 13a-263 — Exceeding speed limit in highway work zone detected by work zone speed control system. Penalty.

(a)No person operating a motor vehicle shall exceed the posted speed limit by ten or more miles per hour, as detected by a work zone speed control system, within a highway work zone where a work zone speed control system is operational.
(b)Except as provided in subsection (c) of this section, the owner of a motor vehicle identified by a work zone speed control system as violating the provisions of subsection (a) of this section shall, (1) for a first violation, receive a written warning, and (2) for a second or subsequent violation that occurs within one year of the date of such owner's most recent violation, be fined seventy-five dollars. Any subsequent violation occurring more than one year after such owner's most recent violation shall be considered a first violation.

(June Sp. Sess. P.A. 21-2, S. 298; P.A. 24-40, S. 44.) History: P.A. 24-40 amended Subsec. (a) by changing 15 or more miles per hour to 10 or more miles per hour, amended Subsec. (b) by adding provision re except as provided in Subsec. (c), adding reference to subsequent violation and adding “that occurs within one year of the date of such owner's most recent violation” in Subdiv. (2), deleting Subdiv. (3) re subsequent violation and adding provision re subsequent violation occurring more than 1 year after most recent violation shall be considered a first violation, added new Subsec. (c) re violation of Subsec. (a) when traveling 85 miles per hour or greater, designated existing provision re owner liability as Subsec. (d) and amended same to add reference to Subsecs. (b) and (c) and add provision re lessee considered owner of motor vehicle and redesignated existing Subsec. (c) as Subsec. (e), effective July 1, 2024.
