Text
(1)The general assembly hereby
finds and declares that:
(a)The Charter Schools Act, part 1 of this article, was enacted by the
general assembly without providing a method for funding the capital construction
needs of charter schools;
(b)Since the enactment of the Charter Schools Act, the general assembly
has enacted legislation requiring a portion of the moneys in the state education
fund to be distributed to charter schools for use in funding capital construction, but
such moneys are not sufficient to fully meet the capital construction needs of
charter schools;
(c)Pursuant to Senate Bill 01-237, enacted at the first regular session of the
sixty-third general assembly, the general assembly declared its intent to establish
a method for funding the capital construction needs
