The commissioner of agriculture
or his or her designee is a peace officer while engaged in the performance of his or
her duties whose authority shall be limited pursuant to sections 35-36-103 and 35-36-312 of the Commodity Handler and Farm Products Act; the Animal Protection
Act, section 35-42-107 (4); and the Pet Animal Care and Facilities Act, section
35-80-109 (6).
