(1)(a) A naturopathic doctor shall maintain continuing professional competency to practice naturopathic medicine.

(b)The director shall adopt rules establishing a continuing professional competency program that includes, at a minimum, the following elements:

(I)A self-assessment of the knowledge and skills of a naturopathic doctor seeking to renew or reinstate a registration;

(II)Development, execution, and documentation of a learning plan based on the assessment; and

(III)Periodic demonstration of knowledge and skills through documentation of activities necessary to ensure continuing competency in the profession; except that a naturopathic doctor need not retake any examination required by section 12-250-107 (2)(d) for initial registration.

(c)The director shall establis

(b) The director shall adopt rules establishing a continuing professional

(c) The director shall establish that a naturopathic doctor satisfies the
continuing competency requirements of this section if the naturopathic doctor
meets the continuing professional competency requirements of one of the
following entities:

(I) A state department, including continuing professional competency
requirements imposed through a contractual arrangement with a provider;

(II) An accrediting body recognized by the director; or

(III) An entity approved by the director.

(d) (I) After the program is established, a naturopathic doctor shall satisfy
the requirements of the program in order to renew or reinstate a registration to
practice naturopathic medicine.

(II) The requirements of this section apply to individual naturopathic doctors,
and nothing in this section requires a person who employs or contracts with a
naturopathic doctor to comply with the requirements of this section.

(2) Records of assessments or other documentation developed or submitted
in connection with the continuing professional competency program are
confidential and not subject to inspection by the public or discovery in connection
with a civil action against a naturopathic doctor. Neither the director nor any other
person shall use the records or documents unless used by the director to determine
whether a naturopathic doctor is maintaining continuing professional competency
to engage in the profession.
