§ 6-1-1807 — Misrepresentations prohibited

(1)(a) Written or digital sales materials for a residential solar electric system or residential battery energy storage system that are provided in the state shall not include the names, logos, pictures, or other indicia of a public utility, cooperative electric association formed pursuant to article 9.5 of title 40, or municipal utility, unless a salesperson has received express written consent to do so from the relevant utility or is otherwise complying with federal fair use laws.
(b)For the purposes of this subsection (1), written or digital sales materials include online sales banners, click-through banners, social media advertisements, and other materials that could generate a sale or sale lead of a residential solar electric system or residential battery energy storage sy
