(a)
(1)If a licensee fails to remit the proper amount of worker contributions required by Chapter 4 (commencing with Section 901) of Part 1 of Division 1 of the Unemployment Insurance Code, or the Employment Development Department has made an assessment for unpaid worker contributions against the licensee that is final, the Labor Commissioner shall, upon written notice by the Employment Development Department, refuse to issue or renew the license of that licensee until the licensee has fully paid the amount of delinquency for the unpaid worker contributions.
(2)The Labor Commissioner shall not, however, refuse to renew the license of a licensee under this
section until the assessment for unpaid worker contributions is final and unpaid, and the licensee has exhausted, or failed to s
