§ 25200.9. — 25200.9. (Amended by Stats. 1993, Ch. 411, Sec. 6.)

The department shall not grant interim status for any hazardous waste facility pursuant to Section 25200.5, unless either of the following applies:
(a)
The hazardous waste management activities at the facility were not subject to the hazardous waste facilities permit requirements until on or after January 1, 1990, and the hazardous waste facility had been engaged in these activities before the date that the activities at the facility became subject to hazardous waste facility permit requirements.
(b)
The hazardous waste management activities at the facility are eligible for the department’s standardized permit application pursuant to Section 25201.6 and the hazardous waste facility was engaged, or authorized to engage, in those activities on September 1, 1992.
