(a)
A person shall not incur civil liability as a result of providing the department with either of the following:
(1)
A foster family agency’s log of resource families that have been approved or have had approval rescinded.
(2)
Notification of a foster family agency’s determination to rescind the approval of a resource family due to any of the following actions by a resource family parent:
(A)
Violation of Section 16519.5, the written directives or regulations adopted pursuant to Section 16519.5, or any other applicable law.
(B)
Aiding, abetting, or permitting the violation of Section 16519.5, the written directives or regulations adopted pursuant to Section 16519.5, or any other applicable law.
(C)
Conduct that poses a risk or threat to the health and safety, protection, or well-being of a child, or the people of the State of California.
(D)
Conviction at any time before or during his or her approval of a crime described in Section 1522.
(E)
Knowingly allowing a child to have illegal drugs, alcohol, or any tobacco product, as defined in subdivision (d) of Section 22950.5 of the Business and Professions Code.
(F)
Committing an act of child abuse or neglect or an act of violence against another person.
(b)
The department, a county, or a foster family agency shall not incur civil liability for providing each other with information if the communication is for the purpose of aiding in the evaluation of an application for approval of a resource family by a foster family agency.
