Text
(a)(1) It is the public policy of the State of Arkansas that each school district shall have a written policy on reduction in force based upon criteria for a layoff and recall of employees, which shall include without limitation an employee's:
(A)Merit;
(B)Ability;
(C)Attendance;
(D)Performance; and (E) Effectiveness.
(2)The following shall not factor more than fifty percent (50%) of the total criteria used by a school district in its written policy on reduction in force:
(A)An employee's seniority;
(B)An employee's length of service with the school district;
(C)An employee's total professional development hours; and (D) The education level of an employee.
(b)A "layoff" is an unavoidable reduction in the workforce beyond normal attrition.
