§ 27-74-303 — Removal - Authority generally - Compensation

(a) The State Highway Commission is authorized and empowered to require the removal of all outdoor advertising signs, displays, and devices which do not conform to the provisions of this subchapter and which are lawfully erected beyond six hundred sixty feet (660') from the nearest edge of the right-of-way, located outside of urban areas, visible from the main-traveled way of the interstate, primary, or any other state highway designated by the commission and erected with the purpose of their message being read from the main-traveled way. (b) The right may be enforced by means of a mandatory injunction or other appropriate remedy. However, just compensation shall be paid upon the removal of signs, devices, and displays that were lawfully erected beyond six hundred sixty feet (660') of the right-of-way line of the interstate, primary, or other state highway. This compensation shall be paid for the taking from the owner of the sign, display, or device, and the taking of all right of title, leasehold, and interest in the sign, display, or device, and the taking from the owner of the real property on which the sign, display, or device is located, of the right to erect and maintain the signs, displays, and devices thereon.
