(a)As used in this section:
(1)"Construction personnel" means an employee of the Arkansas Department of Transportation or a contractor of the State Highway Commission;
(2)"Controlled-access highway" means a state highway or street that:
(A)Is designed for an unhindered flow of traffic without intersections, traffic signals, or property access; and (B) Regulates the ingress and egress of a motor vehicle;
(3)"Highway work zone" means an area upon or adjacent to a highway or street of this state where construction, reconstruction, maintenance, or any other type of work is being performed by construction personnel; and (4) (A) "Pedestrian" means a person afoot.
(B)"Pedestrian" does not include a person who is the driver or passenger of a motor vehicle traveling on a controlled-access hig
