(a)Any person violating any of the provisions of this act shall be guilty of a misdemeanor, unless the violation is by this act or other law of this state declared to be a felony.

(b)Upon conviction, an offender shall be punished:

(1)For a first conviction, by a fine of not more than one hundred dollars ($100) or by imprisonment for not more than ten (10) days;

(2)For a second conviction within one (1) year thereafter, by a fine of not more than two hundred dollars ($200) or by imprisonment for not more than twenty (20) days, or by both fine and imprisonment; and (3) For a third or subsequent conviction within one (1) year after the first conviction, by a fine of not more than five hundred dollars ($500) or by imprisonment for not more than six (6) months, or by both fine and imprisonm
