Text
(a)The Office of Driver Services shall determine from the accident report if the information is to be placed in the driver's record by careful analysis of the report by a person duly appointed by the administrator of the Office of Driver Services.
(b)(1) No record of an accident shall be recorded for any person who is found not guilty in a court of competent jurisdiction after having received a citation for a traffic law violation that resulted from the investigation of the accident.
(2)Where a conviction does not occur, the analysis shall conclude that certain persons were primarily at fault in the accident.
(c)In the instance where a clear determination cannot be made from the investigating police officer's report of the accident, then no entry will be made in the record of any perso
