Text

A person that knowingly violates this subchapter upon conviction is guilty of a:

(1)Class A misdemeanor if:
(A)The value of the property is more than five hundred dollars ($500); and (B) The damage or repair cost to the historical monument is more than one hundred dollars ($100); and (2) Class D felony if the person has been previously convicted of a Class A misdemeanor under this subchapter and:
(A)The value of the property is more than one thousand dollars ($1,000); or (B) The damage or repair cost to the historical monument is more than one thousand dollars ($1,000).
