Whenever the clerk of the county and probate court shall deliver to the clerk of the circuit court any original papers, he shall take a receipt therefor and file the receipt in place of the papers. Civil Code, § 22; C. & M. Dig., § 2235; Pope's Dig., § 2863; A.S.A. 1947, § 23-411.
