27 28 Appeal from the November 26, 2014 written judgment of the United States

29 District Court for the Southern District of New York (Ramos, J.) sentencing

1 The Clerk of Court is directed to amend the official caption to conform to the caption above.

1 defendant Miguel Jesurum principally to a term of 96 months’ imprisonment. 2 Because the district court properly calculated the applicable Guidelines range, 3 we affirm the oral sentence imposed by the district court. However, we remand 4 for the district court to amend the written judgment to conform to the oral 5 sentence. 6 Affirmed and remanded. 7 ____________________

8 RANDALL D. UNGER, Bayside, NY, for Defendant‐ 9 Appellant. 10 11 GEORGE D. TURNER and ANNA M. SKOTKO, 12 Assistant United States Attorneys, for Preet Bharara, 13 United States Attorney for the Southern District of New 14 York, New York, NY, for Appellee. 15 16 POOLER, Circuit Judge:

17 On March 26, 2014, defendant‐appellant Miguel Jesurum pleaded guilty to 18 a two‐count indictment charging him and three codefendants with wire fraud 19 conspiracy in violation of 18 U.S.C. §§ 1343 and 1349 and aggravated identity 20 theft in violation of 18 U.S.C. § 1028A(c). At sentencing, as is relevant here, the 21 district court applied a six‐level enhancement pursuant to 2014 U.S.S.G.

1 § 2B1.1(b)(2)(C) because the offense involved 250 or more victims and, following 2 a Fatico hearing, applied a four‐level enhancement pursuant to 2014 U.S.S.G. 3 § 3B1.1(a) because the defendant was an organizer or leader of a criminal activity 4 that involved five or more participants or was otherwise extensive. Because the 5 district court appropriately applied those enhancements, we reject Jesurum’s 6 argument that the orally pronounced sentence was procedurally unreasonable, 7 and affirm. We remand for the limited purpose of allowing the district court to 8 amend the written judgment to conform it to the oral sentence. 9 BACKGROUND 10 I. The Criminal Scheme 11 On June 20, 2012, Jesurum and three codefendants were charged by grand 12 jury with a two count indictment. Count 1 charged Jesurum and his 13 codefendants with wire fraud conspiracy in violation of 18 U.S.C. §§ 1343 and 14 1349; Count 2 charged them with aggravated identity theft in violation of 18 15 U.S.C. § 1028A(c). On March 26, 2014, Jesurum pleaded guilty without a plea 16 agreement.
