PER CURIAM.

The order of the circuit court denying petitioner’s petition for writ of habeas corpus is reversed, and this case is remanded for consideration of appellant’s petition on the merits. See Dugan v. State, 885 So.2d 1002 (Fla. 4th DCA 2004).
