TO THE HONORABLE COURT OF CRIMINAL APPEALS:

The State of Texas, by and through its State Prosecuting Attorney, respectfully

urges this Court to grant discretionary review of the above named cause.

STATEMENT REGARDING ORAL ARGUMENT

Because this case deals with the facial constitutionality of a penal statute, the

State requests oral argument.

STATEMENT OF THE CASE

Appellant was charged in a two-count indictment with abuse of official

capacity (Count I) and coercion of a pubic servant (Count II). Appellant filed a

pretrial petition for writ of habeas corpus seeking to dismiss both counts. The trial

1 court denied relief and Appellant appealed. The Third Court of Appeals affirmed the

trial court’s ruling as to Count I and reversed as to Count II. Ex parte Perry,

__S.W.3d__, No. 03-15-00063-CR (Tex. App.–Austin 2015).

STATEMENT OF PROCEDURAL HISTORY

The court of appeals issued a published opinion on July 24, 2015. Neither

party filed a motion for rehearing. Appellant filed a petition for discretionary review

on August 18, 2015. The deadline for filing the State’s petition is August 28, 2015.

See TEX. R. APP. P. 68.2(b).

QUESTIONS FOR REVIEW

1) Did the court of appeals incorrectly conflate the tests for First Amendment overbreadth and traditional First Amendment facial unconstitutionality?

2) Applying the definition of “coercion” from TEX. PENAL CODE § 1.07(a)(9)(F), does the coercion of a public servant statute ban a substantial amount of constitutionally protected speech relative to its plainly legitimate sweep?

ARGUMENT

The court of appeals held that, applying the definition of coercion in TEX.

PENAL CODE § 1.07(a)(9)(F), the coercion of a public servant statute1 is facially

unconstitutional under the First Amendment overbreadth doctrine. Ex parte Perry,

Slip op. at 97. In reaching this conclusion, the court of appeals erroneously blended

2 two different First Amendment doctrines. Further, in determining that the statute

banned a substantial amount of protected speech, it failed to recognize the extent of

the statute’s legitimate sweep and considered hypothetical instances of protected

speech that would not actually be included in the statute’s coverage.
