Weiss, J.

Appeal from a judgment of the County Court of Chemung County (Castellino, J.), rendered May 27, 1988, convicting defendant upon his plea of guilty of the crime of operating a motor vehicle while under the influence of alcohol, as a felony.

Defendant was charged with two related felony counts of operating a motor vehicle while under the influence of alcohol. [886]*886Pursuant to a negotiated plea bargain, defendant pleaded guilty to a single count and was sentenced to a term of imprisonment of 1 to 3 years plus a $1,000 fine. Although at the time of the proceedings in this case Vehicle and Traffic Law § 1192 (5) provided for a mandatory fine of not less than $500, the transcript of the plea proceedings shows that neither County Court nor the prosecutor mentioned that a fine would be imposed in addition to the term of imprisonment.
