OPINION OF THE COURT

Jones, J.

In defendant’s appeal arising from his convictions for health care fraud in the fourth degree and grand larceny in the third degree, the primary issue we address is the legal sufficiency of the evidence. This is the Court’s first opportunity to determine the nature of proof required for a conviction under the recently enacted health care fraud statute (Penal Law art 177 et seq.).
