People v. Kellar

Appeal from a judgment of the County Court of Rensselaer County (Harris, J.), rendered June 21, 1990, upon a verdict convicting defendant of the crimes of rape in the first degree, sexual abuse in the first degree and rape in the third degree.
Defendant was indicted in June 1989 for rape in the first degree, sodomy in the first degree, sexual abuse in the first degree, rape in the third degree and sodomy in the third degree. The charges contained in the indictment stemmed from a May 29, 1989 incident in which the victim was attacked in a wooded area in the Town of East Greenbush, Rensselaer County. Following a trial, the jury found defendant guilty of all but the sodomy charges. County Court then sentenced defendant to consecutive prison terms of 8^ to 25 years for the first degree rape conviction and 2\6 to 7 years for the first degree sexual abuse conviction, and a concurrent prison term of 116 to 4 years for the third degree rape conviction. This appeal followed.
