14 BEER, et al., 15 Defendant(s). 16 17 The Court has screened Plaintiff’s complaint and has ordered the case to proceed. 18 Additionally, on June 17, 2025, the Court lifted the stay in this case and ordered Defendants to 19 respond to the complaint by no later than August 15, 2025. (ECF No. 94). Before scheduling this 20 case, the Court will require each party to submit a statement regarding the schedule and discovery 21 matters.1 22 The statements regarding the schedule and discovery shall be filed within thirty days from 23 the date of service of this order. They should be filed with the Court, titled “SCHEDULING 24 AND DISCOVERY STATEMENT,” and include the name of the party filing the statement. 25 They shall address all of the following issues: 26 1 The Court recognizes that Plaintiff filed a scheduling and discovery statement on August 23, 2021, 27 before the case was stayed. (ECF No. 36). Given the length of time that has passed since then, and the possibility of changed circumstances, the Court finds it appropriate for Plaintiff to file an updated 28 scheduling and discovery statement. 1 i. A brief summary of the parties’ claims and/or defenses. 2 ii. The name and, if known, the address and telephone number of each witness, 3 besides expert witnesses, the party may call at trial. 4 iii. A description by category and location of all documents the party may use at 5 trial. 6 iv. Whether any third parties, other than Plaintiff’s institution of confinement, are 7 likely to have relevant documents. 8 v. Whether the party intends to use expert witnesses. 9 vi. If a settlement conference has not occurred, when the party will be prepared to 10 participate in a settlement conference. 11 Defendant(s)’ Scheduling and Discovery Statement shall also address all of the following 12 issues: 13 vii. Whether a third party subpoena directed at Plaintiff’s institution of 14 confinement will be necessary to obtain relevant documents. 15 viii. Whether Defendant(s) intend to challenge the issue of exhaustion and, if so, 16 when Defendant(s) will be ready to file a motion for summary judgment 17 regarding the issue of exhaustion. 18 ix. Whether witness statements and/or evidence were generated from 19 investigation(s) related to the event(s) at issue in the complaint, such as an 20 investigation stemming from the processing of Plaintiff’s grievance(s).2 21 x. Whether there are any video recordings or photographs related to the 22 incident(s) at issue in the complaint, including video recordings and 23 photographs of Plaintiff taken following the incident(s). 24 25
