(PC) Cantu v. Ward
Opinion
JOSHUA JESSE CANTU, Case No. 1:20-cv-00386-JDP Plaintiff, ORDER GRANTING APPLICATION TO PROCEED IN FORMA PAUPERIS v. ECF No. 2 JOHN DOE 1, et al.,
Defendants.
Plaintiff is a former prisoner proceeding without counsel in this civil rights action brought under to 42 U.S.C. § 1983. Former prisoners are not “prisoners” within the meaning of the Prison Litigation Reform Act. See Olivas v. Nevada ex rel. Dep’t of Corr., 856 F.3d 1281, 1282 (9th Cir. 2017) (per curiam). Plaintiff has requested leave to proceed in forma pauperis pursuant to 28 U.S.C. § 1915. Because plaintiff has made the showing required by § 1915(a)(1), his request to proceed in forma pauperis is granted. As soon as practicable, the court will screen plaintiff’s complaint under 28 U.S.C. § 1915(e)(2)(B).
