Appeal from a judgment of the Supreme Court (Cannizzaro, J.), entered January 8, 2002 in Albany County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, to review a determination of respondent Commissioner of Correctional Services finding petitioner guilty of violating a prison disciplinary rule.
Petitioner was the subject of a misbehavior report charging him with violating the prison disciplinary rule that prohibits the unauthorized use of controlled substances after his urine twice tested positive for the presence of cannabinoids. The [736] ensuing disciplinary hearing was held in petitioner’s absence following his refusal to attend.
