Order granting defendants’ motion for summary judgment and judgment entered thereon reversed on the law and the facts, with ten dollars costs and disbursements, and motion for summary judgment denied. There are issues of fact to be tried. Appeal from order denying motion for reargument dismissed. Lazansky, P. J., Young, Kapper, Carswell and Tompkins, JJ., concur.
