The status of this case is the same as that of Insurance Company of North America v. Gish, Brook & Co., ante, p. 78, 105 Pac. 672, except that no order of dismissal has heretofore been made herein. But otherwise the condition of the record is-the same as in that case, and the reasoning and conclusions of the court in that case must follow in this.

The appeal is accordingly dismissed.

All the Justices concur.
