It is also undisputed that the deed restriction at issue in this case expressly provides that its restriction of permitted uses to “single family residential use” does not exclude those protected by federal and state law, such as group homes. a. Did the trial err in finding that the HOA conclusively proved that Mr. Tarr’s operation of his property as a group home for recovering alcoholics and drug addicts is not a “residential use” within the meaning of the deed restrictions? b.
