Opinion
Where exception is taken to a preliminary judgment overruling an oral motion to dismiss an action, and it appears from the bill of exceptions that a final judgment was rendered in the case, upon which there is no assignment of error, this court is without jurisdiction, and the writ of error must be dismissed.
