LAURA TAYLOR SWAIN, Chief United States District Judge: Plaintiff, who is proceeding pro se, is currently incarcerated in Upstate Correctional Facility. By order dated November 14, 2024, the Court dismissed Plaintiff’s complaint, pursuant to 28 U.S.C. §§ 1915(e)(2)(B)(ii), (iii), with 30 days’ leave to replead. On December 2, 2024, Plaintiff submitted a “motion for leave to replead,” in which he states that he is seeking counsel to represent him in this action and includes some facts that he apparently intends to plead in an amended complaint. The Court construes Plaintiff’s application (ECF 9) as a request for an extension of time to file an amended complaint and grants the request. The Court directs Plaintiff to file his amended complaint, if any, within 30 days of the date of this order. The Court encourages Plaintiff, if he continues to proceed pro se, to use the attached amended complaint form. Plaintiff’s amended complaint should be legibly written or typed, and should include facts about who violated his federally protected rights, and how, when, and where

such violations occurred. Plaintiff’s amended complaint will completely replace, not supplement, the original complaint. CONCLUSION The Court construes Plaintiff’s application (ECF 9) as a request for an extension of time to file an amended complaint and grants the request. The Court directs Plaintiff to file his amended complaint, if any, within 30 days of the date of this order. An amended complaint form is attached to this order.

If Plaintiff does not submit an amended complaint within 30 days, then as set forth in the November 14, 2024 order of dismissal, the complaint will be dismissed pursuant to 28 U.S.C. §§ 1915(e)(2)(B)(ii), (iii). The Court certifies under 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue). SO ORDERED.
