Order affirmed, -with ten dollars costs and disbursements. All concur, except Sears, P. J., who dissents and votes for reversal and for dismissal of the petition. See dissenting opinion of Hill, J., in Matter of Whitcher (230 App. Div. 239, 243). (The order denies motion of executrix to dismiss claimant’s petition for compulsory accounting, and directs executrix to account.) Present — Sears, P. J., Taylor, Thompson, Crosby and Lewis, JJ.
