On August 1, 2005, the United States Supreme Court vacated our prior judgment in this case, In re Abdur’Rahman, 392 F.8d 174, 187 (6th Cir.2004), and remanded the case for further consideration in light of Gonzalez v. Crosby, 545 U.S. -, 125 S.Ct. 2641, 162 L.Ed.2d 480 (2005). Bell v. Abdur’Rahman, — U.S. -, 125 S.Ct. 2991, — L.Ed.2d - (2005). The case is hereby returned to the panel to which it was originally submitted for consideration as directed by the Supreme Court.
