ORDER 12 ROBERT BURTON, 13 Respondent. 14 15 Petitioner, a state prisoner proceeding pro se, has filed an application for a writ of habeas 16 corpus under 28 U.S.C. § 2254. The matter was referred to a United States Magistrate Judge as 17 provided by 28 U.S.C. § 636(b)(1)(B) and Local Rule 302. 18 On August 3, 2022, the magistrate judge filed findings and recommendations, which were 19 served on all parties and which contained notice to all parties that any objections to the findings 20 and recommendations were to be filed within fourteen days. Neither party has filed objections to 21 the findings and recommendations. 22 The court presumes any findings of fact are correct. See Orand v. United States, 602 F.2d 23 207, 208 (9th Cir. 1979). The magistrate judge’s conclusions of law are reviewed de novo. See 24 Britt v. Simi Valley Unified School Dist., 708 F.2d 452, 454 (9th Cir. 1983). Having reviewed the 25 file, the court finds the findings and recommendations to be supported by the record and by the 26 magistrate judge’s analysis. 27 ///// 28 ///// ] Accordingly, IT IS HEREBY ORDERED that: 2 1. The findings and recommendations filed August 3, 2022 (ECF No. 55), are adopted in 3 | full. 4 2. Petitioner’s motion to add claims (ECF No. 47), which the court construes as a motion 5 || to amend his § 2254 petition, is denied. 6 3. Within 30 days from the date of this order, petitioner may file a first amended § 2254 7 || petition adding only newly exhausted claims two and four if he chooses to pursue them. If 8 || petitioner chooses to abandon these claims, he may file a notice indicating his intention to 9 || proceed on the claims pending in his original § 2254 petition. 10 4.
