Opinion

PER CURIAM.

Finding no genuine issue of material fact, and being of the opinion that the defendant is entitled to judgment as a matter of law, we affirm the summary judgment entered below in favor of the defendant. Rule 56, A.R.Civ.P. See Knowles v. Blue, 209 Ala. 27, 95 So. 481 (1923); Donald v. Swann, 24 Ala.App. 463, 137 So. 178, cert. denied, 223 Ala. 493, 137 So. 181 (1931).

AFFIRMED.
