Opinion

PER CURIAM.

The appellant has presented cogent evidence to this court that, contrary to the basis of the order dismissing the claimant’s appeal from the denial of benefits to the appeals commission, that appeal was not untimely. We deem it appropriate therefore to vacate the order of dismissal below and remand for an evidentiary hearing on this issue.
