Corines v. The Westchester County Dept. of Correction

District Court, S.D. New York·Decided November 16, 2022·No. 7:22-cv-05179·Unknown

Opinion

UNITED STATES DISTRICT COURT SOUTHERN DISTRICT OF NEW YORK PETER J. CORINES, Plaintiff, 22-CV-5179 (LTS) -against- ORDER THE WESTCHESTER COUNTY DEPT. OF CORRECTION, ET AL., Defendants. LAURA TAYLOR SWAIN, Chief United States District Judge: Plaintiff filed this civil rights complaint on June 17, 2022, asserting claims that arose from December 2018 to August 2019, when he was incarcerated at Westchester County Jail. By order dated September 19, 2022, the Court directed Plaintiff to amend his complaint to cure its deficiencies. Just before the deadline expired, Plaintiff wrote to the Court requesting a 60-day extension of time to amend his complaint. (ECF 7.) In his letter, which the Court received on November 16, 2022, Plaintiff does not provide any reason why he seeks an extension of time. The Court nevertheless extends the time for Plaintiff to file his amended complaint for 30 days from the date of this order. CONCLUSION The Court extends the deadline for Plaintiff to file his amended complaint for 30 days from the date of this order. An Amended Civil Rights Complaint form is attached to this order. The Court also attaches a flyer for the New York Legal Assistance Group, which offers a legal clinic for pro se litigants. The Court certifies under 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue). SO ORDERED. Dated: November 16, 2022 New York, New York
