The above numbered and entitled cause, for purposes of trial below and before this Court, was consolidated with the matter entitled Gateway Barge Line, Inc. v. R. B. Tyler Company, Inc. and Continental Casualty Company, 175 So.2d 867.

For the same reasons this day rendered in the case entitled Gateway Barge Line, Inc. v. R. B. Tyler Company, Inc., et al., the judgment of the Lower Court will be affirmed, all costs of this appeal to be paid by petitioner.

Judgment affirmed.
