Memorandum: Upon examination of the entire record, we conclude that triable issues of fact exist which compel the denial of both plaintiff’s motion for partial summary judgment and defendants’ cross motion for summary judgment (see Sillman v Twentieth Century-Fox Film Corp., 3 NY2d 395).
