The plaintiff, Donna Byrnes (Byrnes), moved for an assessment of damages on Count II of her Complaint. Byrnes originally filed this action against the individual members of the Worcester School Committee, Deirdre Loughlin (Loughlin), the Interim Superintendent of the Worces[414]*414ter School System and the City of Worcester (collectively the defendants). After much skirmishing, her Second Amended Complaint asserted three claims: termination of employment without due process of law (Count I), violation of the Massachusetts Wage Act (Wage Act) (Count II) and defamation (Count III). The court (Ricciardone, J.) awarded summary judgment in favor of the defendants on Counts I and III and in favor of the plaintiff as to liability only on Count II [30 Mass. L. Rptr. 157].
