Two questions are presented : 1. Was Piper a competent witness ? 2. Was the sale from him to Swartwood fraudulent, as being intended to defeat the execution in the hands of Butts 1

The proper test of a witness’ competency on the ground of his religious principles, is, “ whether he believes in the existence of a God who will punish him if he swears false(Omichund v. Barker, Willes, 549: Jackson v. Gridley, 18 John. 98.) There is no evidence in this case; to show what precise creed is embraced in the doctrine of universal salvation: But I do not understand all those Who hold that doctrine, to deny all future punishment. Some only deny the duration of those punishments to be eternal. If this is a true exposition of their faith; then the witness comes within the rulé: For aught that appears he believéd in the existence,of a God and a future state of rewards and punishments: He was; therefore properly admitted.
