AFTER REMAND FROM ALABAMA SUPREME COURT

McMILLAN, Judge.

Pursuant to the Alabama Supreme Court’s decision in Ex parte Bender, 557 So.2d 806 (Ala.1989), this ease is remanded to the circuit court in order for a hearing to be held on the appellant’s petition.

REMANDED WITH INSTRUCTIONS.
