Text
(a)Authority To Designate.—Except as provided in subsection (b) and subject to the requirements of subsection (c), in order to provide safe access routes for the movement of vessel traffic proceeding to or from ports or places subject to the jurisdiction of the United States, the Secretary shall designate necessary fairways and traffic separation schemes for vessels operating in the territorial sea of the United States and in high seas approaches, outside the territorial sea, to such ports or places. Such a designation shall recognize, within the designated area, the paramount right of navigation over all other uses.
(b)Limitation.—
(1)In general.—No designation may be made by the Secretary under this section if—

Pub. L. 119–60, div. G, title LXXIII, §7349, Dec. 18, 2025, 139 Stat. 1782, provided that:
"(a) Regulation.—Not later than 1 year after the date of enactment of this Act [Dec. 18, 2025], the Secretary of the department in which the Coast Guard is operating shall issue a regulation for nearshore and offshore shipping safety fairways, to include a minimum appropriate width of not less than the width proposed in the proposed rule of the Coast Guard titled 'Shipping Safety Fairways Along the Atlantic Coast', issued on January 19, 2024 (89 Fed. Reg. 3587).
"(b) Exception.—The minimum appropriate width under subsection (a) shall not apply to connector, cutacross, or cutoff fairways, Traffic Separation Schemes, or precautionary areas.
"(c) Applicability.—In issuing the regulation under subsection (a), the Secretary shall apply the regulation to the geographic area covered by the proposed rule of the Coast Guard titled 'Shipping Safety Fairways Along the Atlantic Coast', issued on January 19, 2024 (89 Fed. Reg. 3587).
"(d) Effective Date.—The regulation issued under subsection (a) shall take effect on December 31, 2026."
