Text
(a)Authority.—
(1)Except as provided in paragraph (2), the Secretary of the Army, with the concurrence of the Secretary of State, may provide goods and services, including interatoll transportation, to the Government of the Republic of the Marshall Islands and other eligible patrons, as determined by the Secretary of the Army, at Kwajalein Atoll.
(2)The Secretary of the Army may not provide goods or services under this section if doing so would be inconsistent, as determined by the Secretary of State, with the Compact of Free Association between the Government of the United States and the Government of the Republic of the Marshall Islands or any subsidiary agreement or implementing arrangement.
(b)Reimbursement.—

(a)(2), probably means the Compact of Free Association between the Government of the United States and the Governments of the Marshall Islands and the Federated States of Micronesia, which is contained in section 201 of Pub. Designation of United States Army Garrison Kwajalein Atoll As Remote and Isolated Military Installation
Pub. L. 119–60, div. A, title VI, §665, Dec. 18, 2025, 139 Stat. 917, provided that:
"(a) Designation.—Not later than 30 days after the date of the enactment of this Act [Dec. 18, 2025], the Under Secretary of Defense for Personnel and Readiness and the Secretary of the Army, in coordination with the Commander of the United States Army Pacific, shall designate United States Army Garrison Kwajalein Atoll as a remote and isolated military installation.
"(b) Notification.—Not later than 30 days after the date on which the designation described in subsection (a) is completed, the Secretary of the Army shall submit a notification to the congressional defense committees [Committees on Armed Services and Appropriations of the Senate and the House of Representatives] confirming completion of the designation.
"(c) Briefing Required.—Not later than 90 days after the date on which the Secretary of the Army submits the notification described in subsection (b), the Commander of the United States Army Pacific shall brief the congressional defense committees on adjustments to Department of Defense resourcing for and support to United States Army Garrison Kwajalein Atoll as a result of the designation described in subsection (a).
"(d) Definition.—In this section, the term 'remote and isolated military installation' means a military installation determined to be remote and isolated pursuant to the criteria set forth in Department of Defense Instructions 1015.10 and 1015.18, dated July 6, 2009, and May 30, 2024, respectively (or successor instruction)."
