Text
(a)No action shall be brought against the state or the
state engineer or any of his agents or employees for the
recovery of damages caused by the partial or total failure of
any dam, reservoir or diversion system or damages caused by
virtue of the operation of any dam, reservoir or diversion
system upon the ground that such defendants are liable by virtue
of any of the following:
(i)The approval of the dam, reservoir or diversion
system or approval of flood handling plans during construction;
(ii)The issuance or enforcement of orders relative
to maintenance or operation of any dam or reservoir;
(iii)Control and regulation of any dam, reservoir or
diversion system;
(iv)Measures taken to protect against failure during
an emergency; or
(v)Failure to take an action required by the
