Text

(a)Any person who holds a permit to operate a coal mining operation issued under article three of this chapter who violates any provision of any permit issued under or subject to the provisions of this article, or §22-11A-1et seq. and §22-11B-1et seq. of this code is subject to a civil penalty not to exceed $25,000 a day of the violation and any person who violates any provision of this article or of any rule or who violates any standard or order promulgated or made and entered under the provisions of this article, §22-11A-1et seq. of this code or §22-11B-1et seq. of this code is subject to a civil penalty not to exceed $25,000 a day of the violation:Provided, That any penalty imposed pursuant to the Surface Coal Mining and Reclamation Act [§22-3-1et seq.] shall be credited against any en
