295.65 295.65(1) (1) When one operator succeeds to the interest of another in an uncompleted mining operation by sale, assignment, lease, or otherwise, the department shall release the first operator from the duties imposed upon the first operator by this subchapter as to the mining operation and transfer the mining permit and any approvals under ss. 295.60 , 295.605 , and 295.61 to the successor operator if all of the following apply: 295.65(1)(a) (a) The successor operator agrees to comply with the requirements of this subchapter. 295.65(1)(b) (b) The successor operator discloses whether it has forfeited any performance security because of noncompliance with any mining laws within the previous 10 years, posts any bond or other security required under s. 295.59 , and assumes all responsib
