289.36 289.36(1) (1) Definition. In this section, “property” includes any interest in land including an estate, easement, covenant or lien, any restriction or limitation on the use of land other than those imposed by exercise of the police power, any building, structure, fixture or improvement and any personal property directly connected with land. 289.36(2) (2) Property may be condemned. Notwithstanding s. 32.03 , property intended for use as a solid or hazardous waste facility may be condemned if all of the following conditions are met: 289.36(2)(a) (a) The entity proposing to acquire the property for use as a solid or hazardous waste facility has authority to condemn property for this purpose. 289.36(2)(b) (b) The property is determined to be feasible for use as a solid or hazardous was
